What the Bill would do

The Commercial Payments Bill strengthens existing legislation and introduces new measures to improve commercial payment practices and address persistent late payment of commercial debts in the United Kingdom. The Bill: Makes changes to the Late Payment of Commercial Debts (Interest) Act 1998 through: a. Changing its title, to reflect the changes made by this Bill to the “Commercial Payments and Interest on Late Payment Act 1998”. b. Setting payment terms in commercial contracts at a maximum of 30 days for public authorities (where the contract is not covered by the Procurement Act 2023) and 60 days for non-public authorities, subject to limited exemptions. c. Implying a term into contracts that allows a supplier to recover a fixed sum from a purchaser where a dispute is raised late or without sufficient information; and d. Prohibiting contractual terms that exclude or vary the right to statutory interest for late payments.
